Ney Fabiano was found to have spat at Robert Cornthwaite in Melbourne's 1-0 victory over Adelaide last Friday and the independent disciplinary committee handed him an extra three-match ban on top of the five the match review panel had already given him, plus the mandatory one match suspension for the red card.

The club could appeal the decision to the next level and had seven days to lodge an objection to the IDC's ruling.

Tonight the club confirmed they would be filing the paperwork tomorrow.

A statement said: "Melbourne Victory this evening confirmed that it will appeal the decision of the independent Disciplinary Committee that was handed down last night.

"The club will lodge the appeal with Football Federation Australia on Friday morning, with the Appeals Committee hearing date to be advised."

The club had initially contested the validity of the red card handed out by Matthew Breeze based on evidence that there was no intent in Ney Fabiano's actions.

But that was dismissed and despite pleading a similar case to the IDC on Wednesday, the ban was extended until December.
