Johnson has appealed the decision and is currently free on conditional bail.

The incident allegedly occurred on March 28, when Johnson failed to stop for police.

After being pursued he was stopped and tested, recording a blood-alcohol level of almost four times the legal limit.

Having been born in nearby Kurri Kurri, Johnson is a local of Newcastle but played his football last season with the New Zealand Knights. He has also had significant stints overseas with Stoke City, Queens Park Rangers and Milton Keynes. He has also played for the Socceroos on three occassions.

Johnson's Phoenix deal will be in serious jeopardy should his appeal bid fail.
